كشفت المحكمة الإدارية عدم جواز حرمان الموظف من حقه في الإجازة العادية بسبب التقصير في أداء العمل أو لأي سبب آخر، مبينة أن الأنظمة رسمت وسائل محددة لمساءلة الموظف ومحاسبته، وليس من بينها منعه من التمتع بإجازته النظامية.

وأكّد ديوان المظالم أن أحد الأحكام المنشورة في مدوناته القضائية أظهر أن إحدى محاكم الاستئناف الإدارية أيدت حكماً بإلغاء قرار جهة حكومية امتنعت عن تمكين أحد موظفيها من التمتع بإجازته العادية رغم تقدمه بطلبها عدة مرات، مؤكداً أن الجهة الإدارية خالفت أحكام اللائحة التنفيذية للموارد البشرية في الخدمة المدنية برفضها طلبات الإجازة دون تأجيلها وفق الإجراءات النظامية.

وأشار الحكم إلى أن الإجازة العادية حقٌّ نظاميٌّ للموظف، ويجوز تأجيل التمتع بها بما لا يتجاوز 90 يوماً من التاريخ الذي حدده الموظف. ويأتي نشر هذا الحكم ضمن الجهود في نشر الأحكام القضائية، وتعزيز الوعي القضائي والقانوني؛ دعماً لمستهدفات منظومة ديوان المظالم 2030 للريادة وتعظيم الأثر.

The Administrative Court revealed that it is not permissible to deprive an employee of their right to regular leave due to poor job performance or for any other reason, indicating that the regulations have outlined specific means for holding employees accountable, and among them is not the prohibition of enjoying their statutory leave.

The Board of Grievances confirmed that one of the rulings published in its judicial records showed that one of the administrative appeal courts upheld a ruling to annul a decision by a government entity that refrained from allowing one of its employees to enjoy their regular leave despite their repeated requests, emphasizing that the administrative body violated the provisions of the executive regulations for human resources in the civil service by rejecting leave requests without postponing them according to the statutory procedures.

The ruling indicated that regular leave is a statutory right for the employee, and it may be postponed for no more than 90 days from the date specified by the employee. The publication of this ruling is part of efforts to disseminate judicial rulings and enhance legal and judicial awareness; supporting the objectives of the Board of Grievances 2030 for leadership and maximizing impact.
